1. Acceptance of Terms

By downloading, creating an account, or using the Greenopia mobile application ("the App"), you agree to be bound by these Terms and Conditions. Greenopia USA Inc. is a Delaware corporation with a license to do business in California. If you do not agree to these terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age to create an account or post content (such as reviews or comments) on Greenopia. Use of the App is currently provided free of charge to all users.

3. Purpose of Service & Sustainability Data

Greenopia provides information regarding the sustainability practices of businesses to help users make informed decisions. This information is gathered from:

  • Proprietary Assessments: Self-reported data provided by businesses specifically for Greenopia.

  • Legacy Data: Information from previous assessments which may not reflect current day-to-day operations.

  • Third-Party Accreditations: Certifications from external organizations (e.g., B-Corp, California Green Business Network).

4. Accuracy of Information Disclaimer

Greenopia provides the App and all content on an "as-is" and "as-available" basis. * No Audit: We do not independently verify or audit every claim made by a business.

  • No Guarantee: We do not warrant that information is 100% accurate, complete, or up-to-date. Sustainability is a dynamic field, and business practices change.

  • Assumption of Risk: Your reliance on any information in the App is at your own risk. Greenopia is not liable for any discrepancies or "greenwashing" by listed businesses.

  • Reporting Errors: If you believe a listing is inaccurate, please notify us at support@greenopia.com. We will use commercially reasonable efforts to investigate and update the data.

5. User-Generated Content (Reviews & Comments)

By posting reviews, photos, or comments, you grant Greenopia a non-exclusive, royalty-free, perpetual, and worldwide license to use and display that content.

  • You are solely responsible for your content.

  • You agree not to post defamatory, illegal, or infringing material.

  • Greenopia reserves the right to remove any content at its sole discretion.

6. Intellectual Property & Badges

All content, logos, and the proprietary assessment model are the property of Greenopia.

  • Badges: Any "Greenopia Verified" badges or marks remain our property. We grant qualified businesses a revocable license to display them. We reserve the right to revoke this license at any time if a business no longer meets our standards.

7. Account Termination & Misuse

We reserve the right to suspend or terminate your account without notice for:

  • Data Scraping: Attempting to automate the extraction of our proprietary data or assessments.

  • Misuse: Harassment, spamming, or attempting to circumvent App security.

8. Privacy

Your data is governed by our Privacy Policy, which includes your rights under the California Consumer Privacy Act (CCPA).

9. Mandatory Arbitration & Class Action Waiver

Please read this section carefully, as it affects your legal rights.

  • Binding Arbitration: Any dispute arising from these terms shall be settled by binding, individual arbitration in accordance with the American Arbitration Association (AAA) rules.

  • Class Action Waiver: You agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Legal proceedings, if permitted under the arbitration clause, shall take place in Delaware or California at Greenopia’s discretion.
